Terms and Conditions

The website of Recruitasia.com Pte Ltd (“Website”) makes available its service (“Service”) for the linking of individuals seeking employment or employment agencies representing jobseekers (“Jobseeker) with employers advertising vacant positions or recruitment agencies acting on their behalf (“Employer”) (collectively “User.”). Access to and use of the Website constitutes agreement with the Privacy Policy and Terms and Conditions herein, and the terms are, as such, binding upon the User. Recruitasia.com Pte Ltd reserves the right to amend the Privacy Policy and/or the Terms and Conditions at anytime without prior notice. The User is advised to check for amendments from time to time. Continued use of the Website constitutes an affirmation and acknowledgment of the amended Privacy Policy and/or Terms and Conditions, and also constitutes an agreement to continue to be bound by them.

1. Payment of fees

Advertising of jobs and resume database access are chargeable services that the Website provides to the Employer (“Chargeable Services”). The Employer will purchase job advertisements and resume viewings through the Transactions tab in the Employer dashboard, and these services will be made available upon full payment of the fee to the Website. In the event of a free trial promotion, the Employer will be given free access to one or more Chargeable Services, as specified by the Website. Other promotions or discounts may be given from time to time and are at the discretion of the Website.

The Website reserves the right to change service fees, and/or introduce new service fees. Employers who have already purchased credit for Chargeable Services shall not be entitled to any rebate or discount following changes to service fees.

All fees quoted are exclusive of any applicable taxes and duties, unless otherwise specified.

The Employer must provide the Website with accurate payment information, which the Employer is legally authorized to use.

2. Refund Policy

Once purchased, credits for access to the Website’s Service cannot be refunded. Any mistakes made in transactions must be brought to the attention of the Website’s staff by email within 24 hours of the transaction.

3. User’s Obligations

Users shall be solely responsible for the accuracy of all information retrieved, stored and transmitted by them through the Website and the maintenance of the confidentiality of their password, User ID and all activities and transactions performed by the User through his/her User ID. The User may not allow any third party access to the Service through the User account without written approval of the Website. In the event of theft or loss of password, the User must notify the Website immediately by telephone. The User shall remain liable for use of the Services by any third party until such theft or loss is notified to the Website. The User undertakes not to use the Website for any fraudulent, illegal, harassing or offensive activities which are likely to offend or criticize any employer, employee, group or portion of society, or post any content where such posting constitutes the infringement or violation of any right of any third party. The Website does not allow the posting of job advertisements or resumes related to the sex trade, social escort services and the like. The Website does not make any representation or warranty, express or implied, as to the accuracy, timeliness, or completeness of any information on the site (including without limitation any information provided by Users, or any project descriptions/solicitations, proposals, database records or User profiles), nor does the Website undertake to verify, update or correct such information. The Website does reserve the right to review and reject any information it believes contrary to the Terms and Conditions. All Users use the Website and any other websites accessed through it entirely at their own risk, and are responsible for their own communications. The Website does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other Users nor does it endorse any opinions expressed by Users. User’s reliance on content posted by other Users is entirely at their own risk.

The Website does not screen Jobseekers for suitability to the jobs for which they are applying, nor does the Website have any involvement in the screening, selection and hiring practices of any Employer.

By registering for the Service, the User agrees to provide details that are true, and in no way inaccurate, misleading or deceptive. By providing personal details upon registration, the User agrees that the Website can contact the User if any matters arise concerning the User’s account.

The User, by submitting any content to the Website, gives the Website the royalty free, perpetual, irrevocable, sub-licensable, non-exclusive, right to use, reproduce, modify, publish, translate, transmit, communicate, display or create any derivative works from such content.

The User will not infringe on the intellectual property rights of any other User.

The User will not introduce or transmit into the Website any data or program containing computer viruses, worms, or other such malicious content. The Website reserves the right to take legal action against Users found to knowingly breach this clause.

4. Employer obligations

The Employer will post job advertisements and browse resumes only for legitimate and genuine employment positions for which the employer is authorized to hire.

The Employer may not advertise more than one employment position in each job posting.

The Website does not allow the posting of job advertisements that require the Jobseeker to pay any fees to the Employer. Nor does the website allow job advertisements that promote pyramid or other such selling schemes.

The Employer may not post any job advertisements that discriminate against candidates on the basis of race, religious belief, age, gender and marital status.

The Website allows for each job advertisement to be live on the website for up to 30 days. When posting the job advertisement, the Employer chooses the dates between which the job advertisement will be live. Should the Employer choose to post a position for less than the maximum 30 day period, the Website will not reimburse the Employer. Should the Employer wish to repost a job advertisement after the expiry date chosen by the Employer, but within the 30 day period, the Employer will have to purchase new job advertisement credits.

Any information that the Employer obtains through the use the Service is to be used for the sole purpose of hiring for legitimate and genuine employment positions for which the Employer has the authority and genuine intent to recruit. Any such information is not to be used for any purpose other than screening and hiring for employment. Nor is any such information to be used to contact the Jobseeker for any purpose other than potential employment. No such information is to be disclosed to any third party.

5. Suspension or Termination of Service

The Website may terminate its contract with the User, or suspend access to one or more of its services if the Website deems that the User has breached any stipulations of the Terms and Conditions, and if it is not in the public interest to continue providing such services to the User for any reason, or if the User uses the Website’s services in such a manner as to have a negative effect on the reputation or business interests of the Website. No refund or compensation will be given to the User in this instance.
To reactivate services, the User shall contact the Website to rectify any discrepancies that resulted in the suspension/termination of services. The Website reserves the right to choose whether or not it will reactivate a User account.

6. Modification to Service

The Website reserves the right to modify or discontinue the Service with or without notice to the Employer or Jobseeker. A pro-rated refund shall be effected for the remaining unused period or credit. The Website shall not be liable to the Employer or any third party should it exercise its right to modify or discontinue the Service.

7. Use of Data

The Employer hereby agrees and irrevocably authorizes the Website to use any data and information supplied by the Employer for the Website’s marketing and business purposes and retain such data and information in its records and databases, supply such data and information to any other associated companies or selected third parties to use for such purposes, and to its supplying such data and information to such third parties as may be necessary for the operation of the Website.

8. Confidentiality

The Website shall maintain the confidentiality of information submitted by Jobseekers and Employers, as described in the Website’s Privacy Policy. Employers who use the Website must adhere to the same standard of protection of information, as outlined in the Website’s Privacy Policy.
The Website endeavors to protect personal data against unauthorized access, including unnecessary access by its own staff. The Website will access and process personal data only on a ‘need-to-know’ and ‘need-to-use’ basis.

9. Indemnity

The User shall be fully responsible for and will indemnify and hold harmless the Website at all times against all actions, proceedings, costs, claims, expenses, demands, liabilities, losses and damages whatsoever including without limitation for defamation, infringement of intellectual property rights, death, bodily injury, property damage or pecuniary losses howsoever arising which the Website may sustain, incur, suffer or pay arising out of or in connection with the use of the Service by the User or any act or omission of the User.

10. Disclaimer

Whilst every care is taken in the provision of its services, the Website shall not be liable for any loss of information howsoever caused whether as a result of any interruption, suspension, or termination of the service or otherwise, or for the contents, accuracy or quality of information available, received or transmitted through the Website
The Website does not make any representation or warranty, express or implied, as to the accuracy, timeliness, or completeness of any information on the site (including without limitation any information provided by Users, or any project descriptions/solicitations, proposals, database records or User profiles), nor do we undertake to verify, update or correct such information.
The Website does not guarantee continuous or uninterrupted access to Employer or Jobseeker accounts and makes no warranty as to the operation, functionality, or availability of the site. The Website gives no guarantee that its system will be free of operational errors or malicious content such as computer viruses and worms.
The Website shall not be liable for any loss or damages arising through the inadvertent disclosure of any information concerning the User's account or particulars.

11. Governing Law and Jurisdiction

The above Terms and Conditions are governed by the laws of the Republic of Singapore. Any disputes arising in connection with these Terms and Condition shall be subject to the exclusive jurisdiction of the Singapore courts.
